Généralement sur les 103 articles, il y a toujours une loi qui vient compléter la mise en oeuvre.
L’article 55 qui dit qu’après sa nomination, le Premier ministre fait sa déclaration de politique générale est complétée par les dispositions de l’article 97 du règlement intérieur de l’Assemblée nationale qui est une loi organique. c’est dire que pour toutes les institutions c’est la Constitution qui fait un peu la péréquation même des responsabilités dévolues à chaque institution.
Donc la moindre des choses c’est le respect qui s’impose entre les institutions.
Vous ne pouvez pas aujourd’hui être au niveau de l’exécutif et donner un jugement sur une autre institution.

Le Premier ministre dans ses attributions qui sont définies par l’article 57. Dans l’alinéa 2, il est dit le Premier ministre assure l’exécution des lois. Il dispose un pouvoir réglementaire sous réserve des disposition de l’article 43 de la Constitution.
Cela veut dire que le Premier ministre n’a pas le droit de violer surtout la Constitution. En vertu de la séparation des pouvoirs, il devait se réserver de porter un jugement sur le règlement intérieur de l’Assemblée nationale.
D’autant plus que le règlement intérieur est une loi organique.
Il n’y a que le Conseil constitutionnel qui peut se prononcer sur les lois organiques et constitutionnelles. Ce qu’il devait faire (le Premier ministre) c’est de saisir le Conseil constitutionnel pour demander l’avis du président du Conseil constitutionnel sur le règlement intérieur de l’Assemblée nationale.
Il pourrait dire par exemple, je veux faire ma DPG mais il y a eu des interprétations. En ce moment, le Conseil constitutionnel lui dira la direction à prendre.
