On n’a pas encore fini d’épiloguer sur les contrats et autres décisions pris par l’ancien président de la République Macky Sall à quelques jours seulement de son départ du Palais. Après l’affaire de décret de nomination du président de la cour suprême, annulé illico par le Président Diomaye Faye, c’est l’attribution de la concession DakarNave pour 25 ans à une société turque, en mode fast track, qui vient encore d’être cassée par l’Autorité de régulation de la commande publique (ARCOP),dans sa décision du 12 avril dernier dont Sud Quotidien a obtenu copie.
Une belle victoire du groupe Damen/Atmar/Maritalia d’autant plus que le Chef de l’Etat a donné des instructions que la lumière soit faite sur cette affaire aux allures d’un scandale.
Le groupement DAMEN/ATMAR/MARITALIA qui avait saisi d’un recours contentieux l’Autorité de régulation de la commande publique (ARCOP), vient d’obtenir gain de cause, en ce qui concerne l’octroi de la concession de chantier naval au groupement DAKARNAVAL/OZATA/SHIPYARD par l’ancien ministre de la Pêche, Pape Sagna Mbaye et la direction de la Société des Infrastructures de Réparation Navale de Dakar (SIRN) en mars 2024. En effet, le Comité de règlement des différends de l’ARCOP a ordonné la suspension de l’attribution du contrat pour l’exploitation des chantiers de réparation navale dans sa décision du 12 avril dernier.
Le processus de renouvellement de la concession de Dakarnave qui prend fin le 24 juin 2025, sonnait comme un scandale du fait de la violation «flagrante» des règles de passation de marché public.
L’affaire avait choqué plus, d’autant plus que c’est à quelques jours de la fin de règne de l’ancien président Macky Sall à la tête du Sénégal. L’attribution du marché de réparation navale à une société turque révélée par le député Guy Marius Sagna qui serait faite dans la plus grande opacité, vient d’être suspendue par l’Autorité de régulation de la commande publique (ARCOP).
Dans sa décision n°16/2024/ARCOP/CRD/SUS du 12 avril 2024, dont Sud Quotidien a obtenu copie, le Comité de règlement des différends «ordonne la suspension de l’attribution du contrat pour l’exploitation des chantiers de réparation navale et du Centre de Formation (CAFIP) au profit de la Société des Infrastructures de Réparation navale (SIRN) pour le compte du Ministère des Pêches et de l’Economie maritime (MPEM)».
Pour rappel, le groupement DAMEN/ATMAR/MARITALIA avait déposé un recours contentieux contre l’attribution par le MPEM et la SIRN au groupement DAKARNAVAL/OZATA/SHIPYARD. Il avait estimé que l’octroi de la concession du chantier naval a été fait en violation des règles de passation de marché public.
Il faut dire que le contrat qui lie la société Dakarnave à l’Etat du Sénégal, arrive à échéance le 24 juin prochain.
Du coup, le groupement DAMEN/ATMAR/MARITALIA composé d’opérateurs économiques sénégalais avait fait une manifestation d’intérêt depuis 2022 pour reprendre le chantier, «accompagnée d’une note et d’un dossier technico-financier, qui réservait 90% du capital aux opérateurs privé nationaux, 10% devant revenir à la SIRN, le partenaire technique ne devant participer aucunement au capital». Le dossier avait été transmis à la présidence de la République et au MPEM.
«Toutefois, ce n’est que le 7 mars 2024 que nous avons reçu un appel téléphonique du ministre, Pape Sagna Mbaye, nous demandant, si notre partenaire technique, en l’occurrence, les chantiers navals hollandais DAMEN SHIPYARD, pouvait envoyer un représentant à Dakar le 12 mars 2024 », lit-on dans le document de recours contentieux.
La même source d’ajouter : «C’est sur place que nous avons constaté la présence d’autres candidats : chacun étant séparément pour une présentation sommaire des termes de référence du cahier des charges (…). Il s’agissait sans doute possible, non pas d’un appel d’offres international en bonne et due forme qui aurait dû d’ailleurs, faire l’objet de publication partout où besoin sera, mais d’une simple consultation restreinte».
Invités à déposer leurs dossiers le 22 mars 2024, trois candidats se sont présentés.
Un en l’occurrence PIRIOU/NGOM ET FRERES a demandé le report du fait du délai court. Quant à DAKARNAVAL/OZATA/SHIPYARD, il s’est présenté avec «deux dossiers distincts : chantiers de réparation plus slipway, contrairement au groupement DAMEN/ATMAR/MARITALIA qui a présenté une offre globale parce qu’ayant reçu un seul et unique cahier de charge et non deux», nous renseigne-t-on.
«Nous avons constaté, pour le regretter et le fustiger vigoureusement qu’il y avait en réalité, deux cahiers de charge : un pour les chantiers de réparation navale, que nous avons effectivement reçu en même temps que le groupement comprenant OZATA, un autre pour le slipway (Bel Air), dont nous ignorions totalement l’existence, mais que les autorités contractantes ont tenu à nous dissimuler volontairement et très certainement, pour les besoins de la cause, c’est-à-dire, le réserver exclusivement au groupement OZATA alors même que ledit slipway est bien inclus dans les chantiers de réparation navale de Dakar dont il demeure et doit rester un complément remarquable», dénonce le groupement DAMEN/ATMAR/MARITALIA.
Et c’est le 27 mars qu’ils apprendront à travers une publication sur Facebook du député Guy Marius Sagna que le groupement DAKARNAVAL/OZATA SHIPYARD a reçu une lettre émanant du Directeur Général de la société des infrastructures de réparation navale de Dakar (SIRN), Saliou SAMB, annonçant la retenue de son offre pour la gestion de cette infrastructure vitale pour notre économie maritime.
