Jour de vérité pour Karim Meïssa Wade et ses camarades du Pds dont Lamine Thiam, Saliou Dieng, Magatte Sy et Mayoro Faye. En effet, c’est ce vendredi 15 mars que le juge des référés de la Cour suprême va statuer en procédure d’urgence sur la requête abréviative du processus électoral en cours pour la présidentielle du 24 mars prochain qu’ils avaient déposée le 11 mars dernier en même temps que le recours pour contester un décret fixant la date de la prochaine élection présidentielle et celui portant convocation du corps électoral.
Toutefois, interpellé par Sud quotidien hier, jeudi 14 mars sur cette procédure, Dr. Tapsirou Bocar Ba, enseignant-chercheur en Droit public à l´Ugb de Saint-Louis a toutefois précisé que le juge des référés en l’occurrence le Premier président de la Cour suprême ou tout autre magistrat qu’il aura désigné ne peut donner suite à ces recours intentés contre les décrets attaqués ».
Le Dr. Tapsirou Bocar Ba de l’Ugb n’y est pas allé par quatre chemins.
Selon lui, « Le juge des référés en l’occurrence le Premier président de la Cour suprême ou tout autre magistrat qu’il aura désigné ne peut donner suite à ces recours intentés contre les décrets attaqués». Poursuivant son éclairage, l’enseignant chercheur en Droit public évoque deux raisons.
La première renvoie selon lui, à la recevabilité et la deuxième est une question de fond.
« Sur la recevabilité, on peut se poser deux questions : les requérants ont-ils intérêt à agir ? Ensuite, l’acte attaqué est-il justiciable devant la Cour suprême ?
Par rapport à la première question notamment relative à l’intérêt à agir, il faut souligner, à ce niveau, que les requérants, qu’ils invoquent leur qualité de candidats spoliés ou leur qualité d’électeur ne peuvent contester les dits décrets devant la Cour suprême ou devant le juge des référés », a précisé Dr. Tapsirou Bocar Ba.
Avant d’ajouter dans la foulée : « S’ils invoquent leur qualité de candidats spoliés, la Cour suprême va leur opposer que seuls les candidats valablement retenus par le Conseil constitutionnel peuvent exercer un recours pour contester un décret relatif au processus électoral ».
Loin de s’en tenir-là, l’enseignant chercheur en Droit public à l’Unité de formation et de recherche (Ufr) des Sciences Juridiques et Politiques (SJP) de l’université Gaston Berger rappelant une jurisprudence de la Cour suprême de 2018 dans l’arrêt Yaya Niang souligne que Karim Wade et compagnie ne pourront pas également invoquer leur qualité d’électeur.
« Dans cet arrêt Yaya Niang de 2018, la Cour suprême elle-même a considéré que la qualité d’électeur est insuffisante pour exercer un recours tendant à faire réinscrire un candidat rejeté des listes électorales, en l’occurrence Karim Meïssa Wade à l’époque ».
Et de poursuivre : « Le décret portant convocation du corps électoral et celui portant fixation de la date de l’élection présidentielle sont considérés par une jurisprudence constante comme des actes de gouvernement. Autrement dit, des actes qui sont injusticiables devant le juge administratif ».
« Ce principe est illustré par l’arrêt Ousmane Sonko de 2016 de la Cour suprême.
Dans cet arrêt, la haute juridiction avait rejeté les recours intentés par Monsieur Ousmane Sonko considérant que les décrets attaqués sont injusticiables devant la Cour suprême en raison de leur caractère d’acte de gouvernement », rappelle encore avec insistance Dr. Tapsirou Bocar Ba qui évoque également d’autres obstacles dans le fond contre ce recours.
Citant les dispositions de l’article 92 de la Constitution, il précise que les décisions du Conseil constitutionnel s’imposent non seulement au pouvoirs publics mais aussi à toutes les autorités administratives et juridictionnelles, y compris la Cour suprême qui est donc tenue de se conformer aux décisions déjà rendues par le Conseil constitutionnel qui a imposé l’obligation d’organiser le scrutin avant le 2 avril.
