Reconnu coupable d’escroquerie portant sur la somme de 920.000 francs au préjudice de société URASHOP.SN, le sapeur-pompier El. H. M. Mbow a été dispensé de peine par le tribunal des flagrants délits de Dakar où il comparaissait, hier.
Le Caporal sapeur-pompier El. H. M. Mbow est un as de l’escroquerie. Pour ce délit, il a été appelé hier, à la barre du tribunal des flagrants délits de Dakar. Né en 1999, il est poursuivi par la société URASHOP.SN qui lui reproche de l’avoir grugé de 920.000 francs CFA et faux et usage de faux. En effet, en activité à Grand Mbao, le jeune sapeur-pompier obnubilé par les biens matériels assouvissait son désir grandissant d’acquérir de nouveaux matériaux électroménagers en grugeant la société URASHOP.SN.
En service à la 13ème compagnie d’incendie et de secours de Guédiawaye, il a été orienté à cette entreprise par un de ses collègues qui avait déjà bénéficié des services de l’équipe URHASHOP où il a commandé après avoir satisfait aux conditions, un téléphone de marque techno Sparck7 le 27 décembre 2021. Convaincu de l’existence de certaines failles sécuritaires dans le mode de fonctionnement, El. M. Mbow s’est rendu successivement dans les mairies de Malika et de Guédiawaye à la recherche de pièces d’identité égarées et ramassées puis déposées à ces endroits.
Pour échapper à tout soupçon, il faisait croire à chaque fois qu’il est à la recherche de sa carte d’identité nationale perdue. Il profite ensuite de la distraction des agents de la mairie pour voler quatre pièces d’identité à l’hôtel de ville de Guédiawaye et quatre autres à celui de Malika. Il prend le soin de choisir des pièces appartenant aux hommes dont la tranche d’âge est comprise entre 20 et 40 ans. Avec ces cartes d’identité volées, il est arrivé à confectionner huit cartes d’identité professionnelle dont quatre de police et quatre autres de douane à partir d’un logiciel informatique.
Après avoir collecté une telle documentation, le sapeur a procédé à l’étape suivante qui a consisté à l’achat de huit puces du réseau de téléphonie Expresso à partir desquelles il appelait les membres de l’équipe URASHOP pour passer huit commandes de téléphones dans la période du 30 décembre 2021 au 31 janvier 2022. Après la livraison de chaque téléphone, la puce utilisée est retirée et jetée à la poubelle. Ce qui l’exemptera de payer le reliquat.
C’est au mois d’avril 2022 que la société a constaté le non-respect des engagements concernant huit contrats de vente. Une vérification minutieuse effectuée sur les dossiers a permis de relever des vices particulièrement sur huit cartes professionnelles. À compter de cette date, la vigilance est de mise et tout document constituant le dossier de contrat de vente a fait l’objet d’une étude approfondie avant que le client ne reçoive sa livraison.
Dominé par son insatiabilité, El. M. Mbow est reparti sur ces mêmes bases le 18 Août 2022 en voulant s’offrir un nouveau téléphone de marque Samsung A23 (128+4) avec la carte d’identité du nommé Bada DIOP qu’il a ramassé dit-il en Face de l’Orme. Mais, cette fois-ci, il n’échappera pas à la vigilance de l’équipe URASHOP. Un dispositif mis en place a permis de le démasquer à la caserne des sapeurs-pompiers de Guédiawaye, endroit fixé pour la livraison du matériel. Sachant que les carottes sont cuites, il en abdique en se confiant à ses supérieurs qui le conseillent d’aller à la gendarmerie.
Face aux juges du tribunal des flagrants délits de Dakar hier, il a reconnu les faits. «J’avais des moments où je vivais dans une situation précaire. J’ai eu du mal à supporter les prélèvements et les charges de mon salaire. Après les études secondaires, j’ai fait une formation en informatique lycée Technique de Lafosse. Quand les faits se sont produits, j’en ai parlé à mes supérieurs. Et c’est ces derniers qui m’ont orienté vers la gendarmerie», a-t-il justifié son acte.
«Vous faites des choses aussi débiles. Vous risquez votre carrière. Vous savez ce que vous risquez en agissant de la sorte ? Il faut se ressaisir d’accord !», lui a asséné le juge. La partie civile n’ayant déféré à la convocation, la parole a été donnée au substitut du procureur de la République qui a requis l’application de la loi.
Prenant la parole, l’avocat du prévenu Me Seyba Danfakha a sollicité une application bienveillante de la loi pénale. «Il y a une constance des faits. Ils ne souffrent d’aucune contestation. Il les a reconnus jusqu’à la barre du tribunal. Vous voyez qu’il n’est pas fier de ce qu’il a fait. Ce garçon est en âge de maturation. Il a déjà été sanctionné. Et quel que soit l’issue de cette affaire, il va répondre devant sa hiérarchie. Faîtes-lui bénéficier d’une peine de sursis», a plaidé Me Danfakha.
Finalement le tribunal qui a reconnu le prévenu coupable lui a toutefois dispensé de peine. Les intérêts civils du plaignant ont été réservés.
