L’Autorité de Régulation des Télécommunications et des Postes (ARTP) rappelle au grand public et à toutes les parties prenantes que l’identification des abonnés au moment de la souscription à un service de communications électroniques (mobile, fixe, Internet) auprès des opérateurs SONATEL (ORANGE), SAGA AFRICA HOLDINGS LIMTED (YAS), EXPRESSO, CSU (HAYO), SIRIUS TELECOMS (PROMOBILE) est une exigence légale et réglementaire.
L’Autorité de Régulation des Télécommunications et des Postes (ARTP), à travers des missions de vérification effectuées à Dakar et à l’intérieur du Sénégal dit avoir constaté que l’identification n’est plus respectée par les distributeurs et auprès des points de ventes des opérateurs, au moment de la souscription de cartes SIM par les clients.
Sous rapport et conformément à l’article 36 de la loi n°2018-28 du 12 décembre 2018 portant Code des Communications électroniques, « les opérateurs doivent procéder à l’identification de tous les utilisateurs de leurs services de communications électroniques au moment de la souscription aux services qu’ils fournissent et conservent les données de nature à permettre leur identification ».
Ainsi donc, pour les personnes physiques ; il est exigible:
_la présence physique des clients lors de la souscription ou la présentation d’une procuration légalisée pour les abonnés non présents ;
_la limitation des cartes SIM à trois (03) par abonné et par opérateur de téléphonie mobile ;
_la présentation de la Carte Nationale d’Identité « CNI » ou du passeport en cours de validité pour les nationaux et les ressortissants de la CEDEAO ;
_la présentation du passeport pour les étrangers (autres que CEDEAO) », souligne la source.
S’agissant des personnes morales et autres organismes : il est indispensable
_la présentation du registre de commerce et du NINEA pour les entreprises ;
_la présentation d’un contrat de droit privé pour les ambassades et autres organismes internationaux accrédités », lit-on dans le communiqué reçu en date d’hier, dimanche 19 janvier 2025.
