Le décret portant nomination des nouveaux membres de la Commission électorale nationale autonome (CENA) à moins de 4 mois du scrutin présidentiel de Février 2024 va être attaqué. Après l’annonce de l’expert électoral, Ndiaga Sylla, il s’en est suivi celle de Amadou Ba, juriste et membre du directoire du parti Pastef, dans un texte publié sur sa page Facebook.
Ce après que le ministre des Affaires étrangères, Agrégé en Droit constitutionnel ait fait une publication pour démontrer que M. Sylla n’a pas qualité à s’attaquer au décret précité.
Ismaila Madior Fall veut éviter une énième humiliation devant la Cour suprême
Selon Amadou Ba, ce qui motive la sortie de Ismaila Madior Fall sur les réseaux, c’est l’intention de décourager le recours annoncé par Ndiaga Sylla et qui va être suivi par des milliers d’autres Sénégalais.
« Il revient comme d’habitude pour contester la qualité pour agir de ndiaga sylla et de l’opposition.
Bizarrement, il ne cite aucun texte à l’appui de son argumentaire. On peut lui sortir mille jurisprudences étayant l’intérêt à agir des électeurs et des candidats », écrit-il d’emblée pour répondre au ministre des Affaires étrangères.
Avant d’assurer: « Walahi il sait que les irrégularités du décret vont entraîner son annulation par la Cour suprême. Et c’est pour éviter cette énième humiliation, qu’il veut intimider et décourager les futurs requérants »
Amadou Ba annonce ainsi que lesdits recours seront déposés en référé au plus tard mardi 7 novembre..
Appel à une saisine collective
Ainsi, le membre du directoire de Pastef indique que « Pour parer à toute éventualité de rejet pour défaut d’intérêt à agir, le recours contre le décret de la CENA doit être un recours collectif signé par des électeurs, les candidats indépendants et les partis et coalitions ».
L’expert électoral Ndiaga Sylla a bien motivé samedi son recours contre ledit décret.
« En effet, ce décret viole le principe de la permanence de l’organe de contrôle et de supervision des élections et son colloraire, la clause de la fin et du renouvellement des mandats (art. L.4 et L.7 du code électoral). De plus, il y a un membre de la CENA nommé en 2018 et dont le mandat n’a pas expiré ».
