D’ailleurs, le commerçant soutient à la barre qu’on l’a appelé vers 23 h pour lui dire que son magasin a été ouvert.
Il ajoute que quand il est arrivé sur les lieux, des personnes lui ont signifié que ses bourreaux se trouvent au cinquième étage de l’immeuble. En prenant les escaliers, il a croisé le gardien avec deux sachets de chaussures à la main qui lui a confirmé la présence des cinq prévenus au cinquième étage.
Il a eu le temps d’alerter la police qui d’ailleurs l’a accompagné et qui ont fini par mettre la main sur ces malfrats.
À l’enquête, Moustapha Nd. avait déclaré qu’il avait emporté deux sachets qu’ils ont amenés au 5e étage chez Saliou D. Quant à Waly Sarr, il reconnaît avoir ramassé les deux sacs qu’il a confiés à une certaine Adji.
Le parquet dans son réquisitoire soutient que les faits sont constants et demande l’application de la loi.
Selon leur conseil, le gardien est allé trop vite en besogne pour les traiter de voleur sans vérification préalable. “Ils voulaient sauver leur congénère. Ils étaient là pour sécuriser leurs bagages”, a plaidé la robe noire.
Ainsi, la robe noire a sollicité la relaxe pure et simple des garçons à titre principal ou les relaxer au bénéfice du doute à titre subsidiaire et à titre infiniment subsidiaire de leur faire une application extrêmement bienveillante de la loi pénale.
Le juge a finalement relaxé tous les prévenus et demande à Waly S. de payer la somme de 200.000 francs à la partie civile pour cause de tout préjudice confondu.
