Le samedi 28 décembre 2024, l’Assemblée nationale sera le théâtre de deux événements majeurs pour la vie politique sénégalaise. Ousmane Sonko, Premier ministre, participera au vote du projet de loi de finances pour l’année 2024, une étape cruciale pour définir les priorités économiques du gouvernement.
En parallèle, les députés installeront officiellement la Haute Cour de justice, une juridiction d’exception destinée à juger les plus hautes autorités de l’État.
Le budget 2024 sous les projecteurs
Conformément à l’article 86 de la Constitution, le vote du budget devra se dérouler sans débat préalable et être finalisé avant la fin de l’année. Ce projet de loi de finances reflète les engagements du gouvernement pour l’année à venir, notamment en matière de développement économique et de gestion des ressources publiques.
Ce passage devant l’Assemblée engage directement la responsabilité de l’exécutif.
La mise en place de la Haute Cour de justice
La séance plénière sera également marquée par l’installation de la Haute Cour de justice, une instance spécialisée dans le jugement des hauts responsables de l’État pour des actes criminels ou délictuels commis dans l’exercice de leurs fonctions.
Les huit juges titulaires et huit suppléants, élus par l’Assemblée nationale, prêteront serment avant de prendre leurs fonctions.
Rôle et composition de la Haute Cour
Présidée par le Premier Président de la Cour suprême, la Haute Cour de justice dispose d’un champ de compétence précis :
_Le Président de la République peut être jugé en cas de haute trahison, bien que cette notion reste floue dans le droit sénégalais, ce qui pourrait soulever des difficultés d’interprétation.
_Le Premier ministre et les ministres, ainsi que leurs complices, peuvent également comparaître devant cette instance pour des crimes ou délits graves, tels que le complot contre la sûreté de l’État.
_Le ministère public est représenté par le Procureur général près la Cour suprême.
Quant à la mise en accusation du Président ou des membres du gouvernement, elle nécessite une résolution adoptée à la majorité qualifiée des trois cinquièmes des députés, soit 99 votes sur 165.
