Âgé de 19 ans, Ousseynou Kassé a ôté la vie à cinq personnes lorsqu’il déplaçait le camion qui a été mis à la disposition de son employeur Khadim Diagne pour dépannage. Après plusieurs jours dans le coma, le mécanicien qui conduisait sans permis ainsi que son patron, ont été condamnés à deux ans de prison par le tribunal des flagrants délits de Dakar, ce vendredi 9 septembre 2022, renseigne “Rewmi”.
L’accident est survenu à Bargny le mardi 23 août 2022. Alors qu’il était au volant d’un poids lourd, Ousseynou Kassé a percuté violemment un bus Tata. Cinq passagers ont perdu la vie et 18 autres blessés. Ousseynou Kassé n’est pas sorti indemne de cette catastrophe. Accueilli dans un état critique au service neurologique de l’hôpital Fann, il a été placé dans le coma pendant plusieurs jours.
Auditionné plus tard sur son lit d’hôpital, le mécanicien a expliqué que le camion a été confié à son patron Khadim Diagne pour dépannage. Mais, un gars s’était présenté à leur garage pour leur demander de déplacer le véhicule. Sur ces entrefaites, Ousseynou Kassé a indiqué être entré en contact avec son employeur qui lui a donné l’ordre de déplacer le camion. Mais, il a perdu le contrôle du véhicule qui est entré en collision avec le bus qui était en direction de Toubab Dialaw. Plus grave, le mis en cause roulait sans permis.
Alpagué, Khadim Diagne, 33 ans, a réfuté le chef d’abandon de véhicule à un tiers non détenteur de permis. Alors qu’il a disparu dans la nature quand il a été joint au téléphone et mis au courant de l’accident. Ses dénégations ont continué jusqu’à la barre du tribunal des flagrants délits de Dakar, ce vendredi 9 septembre 2022. A l’en croire, c’est le chauffeur Gora Seck qui a amené le camion dans son garage en son absence. Mais, il a laissé les clefs dans le neiman. Ousseynou Kassé a déplacé le poids lourd de son propre chef. « Quand on m’a informé de l’accident, mon portable est tombé par terre. J’étais sous le choc. C’est pourquoi je me suis réfugié à Touba », s’est expliqué Khadim Diagne. Joue droite recouverte de bandage, gémissant de douleur, Ousseynou Kassé a maintenu ses déclarations préliminaires. « J’ai commencé à travailler dans ce garage depuis 2019. Je conduisais sans permis. Quand j’ai heurté le bus, je me suis réveillé à l’hôpital », ressasse-t-il.
De l’avis de la représentante du Ministère public, Khadim Diagne est plus responsable dans cette tragédie. Pour sa répression, elle a sollicité deux ans, dont six mois ferme. S’agissant de son co-prévenu, la parquetière a requis deux ans, dont deux mois ferme pour homicide involontaire, défaut de permis et défaut de maîtrise.
Pour les 10 avocats qui se sont succédé au prétoire, on ne peut pas retenir la responsabilité de Khadim Diagne dans cette affaire. Ils ont à l’unanimité plaidé le renvoi des fins de la poursuite. Me Abdoul Daff a, pour sa part, estimé qu’Ousseynou Kassé est mentalement et physiquement détruit. « Il a cinq morts sur sa conscience. Il a la joue lacérée, les nerfs atteints. Malgré tout ce qu’il est en train d’endurer, il est resté grand. Il a besoin de votre clémence », a insisté l’avocat. Dans son délibéré, le juge a condamné Khadim Diagne à deux ans, dont trois mois ferme et Ousseynou Kassé à deux ans, dont deux mois ferme.
