Les attaques qui visent les institutions judiciaires comme le Conseil constitutionnel, irritent le Premier président de la Cour d’appel de Dakar, qui condamne ces attaques injustifiées et critiques que nourrissent et entretiennent des positions partisanes et le mépris envers les juges.
Enquête parlementaire contre des membres du Conseil constitutionnel, critiques contre cette juridiction par des candidats recalés ont suivi la décision définitive des sept «Sages» sur les candidats à la Présidentielle de 2024. Antérieurement à cela, des juges ont été traités de tous les noms après des décisions rendues dans des affaires impliquant le leader politique Ousmane Sonko. Des faits qui indisposent au plus haut point le Premier président de la Cour d’appel de Dakar, Amady Diouf.
Occasion lui a été offerte vendredi d’asséner ses vérités aux contempteurs de la Justice, non sans prévenir des effets néfastes de ces actes sur la vitalité de la démocratie.
Il n’a nommément cité aucune personne ou formation politique, mais a clairement laissé entrapercevoir les destinataires de ses dires. «Les dernières actualités nous donnent l’exemple saisissant du niveau d’incivilité et de déroute morale auquel les juridictions font face.
L’une de nos juridictions les plus éminentes est traînée sans gants dans la boue par des acteurs qui aspirent dans le pays à des fonctions éminentes.
Le mépris envers les juges dont il ne faut jamais rire ou se complaire, est le signe d’une faillite morale et le début d’un effondrement de la démocratie», a-t-il souligné lors de l’inauguration du Palais de justice de Rufisque, implanté au Pôle urbain de Diamniadio, à proximité de la Sphère ministérielle Habib Thiam.
«Force est de souligner que nous exerçons nos offices dans un contexte où les institutions républicaines, particulièrement la Justice, subissent des attaques injustifiées et des critiques que nourrissent et entretiennent des positions partisanes et la méconnaissance profonde du mode de fonctionnement de la Justice», a-t-il encore noté, s’adressant à ses collègues qu’il a exhorté à «rester fiers d’un métier qui porte les fondations de la liberté et de l’ordre juste».
Il a ainsi rappelé l’obligation aux professionnels de rendre la justice dans le respect de la loi applicable et dans le respect des règles.
«Elle ne doit pas rendre service, ni tenter de contenter quiconque ou de chercher vaillamment à déplaire coûte que coûte, juste pour le plaisir de déplaire», a-t-il insisté. Et de poursuivre : «Rien n’est pire comme nous le rapporte l’histoire, qu’une justice rendue que dans le sens, pour ses auteurs, d’épouser l’air du temps ou dans le sens de rechercher une gloire personnelle du juge pour plaire à des éléments du groupe social les plus exaltés dans les réseaux sociaux juste pour bénéficier d’une aura médiatique ou populaire.» Comme pour dire !
