Le Conseil constitutionnel a publié samedi soir la liste définitive des candidats pour la présidentielle du 25 février 2024. Des 21 candidats retenus après l’épreuve du parrainage, seul Karim Wade, candidat du Parti démocratique sénégalais (Pds), ne figure pas sur la liste définitive.
« Considérant qu’en réponse à la requête de Thierno Alassane Sall, Karim Meïssa Wade explique que la décision du Conseil constitutionnel nº1/E/2024 du 12 janvier 2024 disposant que les dossiers de candidature déclarés recevables, dont le sien, sont accompagnés des pièces et mentions exigées par la loi, et que leur examen n’a révélé aucune irrégularité relative aux conditions de fond prévues par les articles 28 et 29 de la Constitution, c’est à tort que Thierno Alassane Sall remet en cause sa candidature; que pour établir qu’il est exclusivement de nationalité sénégalaise, Karim Meïssa Wade a produit une attestation par laquelle le Consul près l’Ambassade de France à Doha atteste qu’il a déposé une déclaration de perte de la nationalité française le 26 octobre 2023 et une copie du décret du 16 janvier 2024 publié au Journal officiel de la République française nº 13 du 17 janvier 2024 duquel il résulte que Karim Meïssa Wade est libéré de son allégeance à l’égard de la France », lit-on dans la décision des « Sept sages », qui rappellent que le candidat à la présidentielle doit être de nationalité exclusivement sénégalaise, selon les lois en vigueur.
Les juges ont, en outre, souligné que l’article L.121 du Code électoral dispose que la déclaration de candidature doit être accompagnée d’une déclaration sur l’honneur par laquelle le candidat atteste qu’il a exclusivement la nationalité sénégalaise.
Une déclaration sur l’honneur que Wade-fils a signée le 21 décembre 2023.
Mais, selon la juridiction supérieure, l’attestation par laquelle le Consul près l’Ambassade de France à Doha reproduit une déclaration de Karim Meïssa Wade n’est pas de nature à établir la perte, par ce dernier, de la nationalité française.
Car, poursuit le Conseil, l’article 23-4 du Code civil français prévoit que « perd la nationalité française le français, même mineur, qui, ayant une nationalité étrangère, est autorisé, sur sa demande, par le Gouvernement français à perdre la qualité de français. Cette autorisation est accordée par décret ».
En définitive, les juges du Conseil constitutionnel considèrent que le décret produit par le candidat du Pds prouve que ce dernier a perdu la nationalité française à compter du décret du 16 janvier 2024, publié le 17 janvier 2024 que si, de ce fait, sa double nationalité, cause potentielle d’irrecevabilité a cessé à partir de cette date.
« Sa candidature a été déclarée recevable sur la foi d’une déclaration sur l’honneur inexacte dès lors qu’au moment de cette déclaration datée du 21 décembre 2023, le candidat n’avait pas exclusivement la nationalité sénégalaise », a motivé le Conseil.
Candidat à la présidentielle, Thierno Alassane Sall avait introduit un recours contre la candidature de Wade fils.
Un décret de l’État français du 16 janvier a consacré la perte de la nationalité française de Wade fils alors qu’il a déposé sa candidature – avec une déclaration sur l’honneur – le 21 décembre 2023.
