Quatre jeunes ont été arrêtés dans le cadre de l’enquête sur l’incendie criminel à Denver qui avait tué 5 membres d’une famille sénégalaise en août dernier.
Il s’agit de Djibril et Adja Diol, un couple, leur fille de trois ans, Khadija, Assane Diol et sa fille, Awa Bèye. Les suspects – trois sont des mineurs, le 4e âgé de 23 ans, ont été arrêtés dans le comté de Jefferson à leurs domiciles.
Ils font face à 28 chefs d’inculpation, dont « meurtre au premier degré avec une extrême indifférence, incendie criminel, cambriolage et voies de fait ».
Mais l’affaire connait de nouveaux développements. Selon les informations du journal Les Echos, reprises par Senenews, l’on se dirige vers la libération des suspects.
Un mandat de perquisition a été délivré par la police à Google pour obtenir des données sur toute personne ayant recherché l’adresse de la maison où vivait la famille sénégalaise.
Cette requête est sur le point de tout changer et risque de faire libérer les suspects.
Les avocats d’un des mis en cause veulent que le juge rejette cette perquisition au motif que la police a violé la protection de l’adolescent en invoquant le 4e amendement contre les fouilles abusives.
« La perquisition effectuée par la police dans cette affaire implique de réels problèmes de confidentialité qui devraient inquiéter tous les citoyens du pays », a déclaré l’avocat Me Michael Juba.
Les défenseurs de la vie privée sur Internet sont totalement en phase avec les avocats de la défense. Ils réclament depuis longtemps l’interdiction de tels mandats de perquisition.
Rappelons que l’incendie s’est produit dans le 5300 bloc de la rue North Truckee à Denver vers 2:30 h du matin.
Les victimes, originaires de Guédiawaye, dans la banlieue dakaroise, ont été été inhumés au cimetière de Yoff.
La maison de la famille Diol n’était pas ciblée, les pyromanes s’étant trompés de cible car le domicile de la bande rivale en question se trouvait à quelques mètres de celui de la famille sénégalaise.
