Toufan Feyzi Nizamoglu est un citoyen turc ayant obtenu le 29 juillet 2019 le statut de réfugié au Sénégal (Décret No 2019-1217 du 29 juillet 2019). Des associations de défenses des droits de l’homme sénégalaises renseignent, dans un communiqué conjoint, que l’individu a été convoqué le 29 juin dernier par la Direction des investigations criminelles (DIC) pour « certainement discuter » avec lui de la mise en œuvre de son Arrêté d’expulsion (N° 011337 du 13 mai 2022) du territoire national.
« Depuis cette date, il est retenu dans les locaux de ladite institution pour des raisons que sa famille ignore. Il n’est, à notre connaissance, pas accusé d’avoir commis un crime et n’a pas fait l’objet d’une inculpation qui puisse justifier sa garde-à-vue prolongée dans ces locaux de la Police nationale », fustigent les droits-de-l’hommistes.
Le communiqué conjoint estime que ce maintien à la DIC pendant dix- sept (17) jours est assimilable à une détention arbitraire : « il ne respecte ni les garanties judiciaires, ni les principes du caractère raisonnable, de la nécessité et de la proportionnalité posés par les lois pénales nationales ».
Les trois associations ont lancé un appel à l’endroit des autorités pour une résolution de cette situation : « Nous demandons donc au Ministre de la Justice, dépositaire des lois pénales de notre pays, de bien vouloir ordonner à la DIC de libérer immédiatement Monsieur Toufan Feyzi NizamogluT à défaut de pouvoir l’inculper afin qu’il puisse retrouver sa famille en attendant que la justice sénégalaise se prononce sur les deux recours (en suspension et en annulation de la mesure ministérielle) qu’il a introduits devant la Chambre administrative de la Cour suprême, le 30 juin 2022 ».
