Le Professeur agrégé en Sciences politiques à l’université Gaston Berger de Saint-Louis Maurice Soudieck Dione a relevé des contradictions dans l’adresse du Président de la République. Selon lui, Macky Sall ne tire pas toutes les conséquences de la décision du Conseil Constitutionnel.
«C’est un entretien qui fait un peu le tour de l’actualité et de la décision cruciale du report de l’élection présidentielle du 25 février 2024. D’abord, la première chose que l’on remarque, c’est que le Président est resté une semaine sans s’exprimer alors que le Conseil constitutionnel avait dit qu’il fallait fixer une date pour l’élection présidentielle dans les meilleurs délais.
Ce temps aurait pu être mis à profit vu qu’on est dans une situation d’urgence. La deuxième lecture qu’on peut faire, c’est que le Président de la République demande à ce qu’on organise des concertations.
Il avait d’abord dit qu’il organise des consultations. Maintenant, on passe des consultations à des concertations ou à un dialogue comme il le dit. Dans ce dialogue, on met ensemble des intérêts tout à fait contradictoires parce qu’on a les candidats retenus définitivement par le Conseil constitutionnel mais le Président de la République a rajouté les candidats «spoliés» du parrainage. Là aussi, on ne comprend plus. D’abord, il y a un problème de droit qui se pose.
Le Président de la République avait dit lui-même, lorsqu’il avait reçu ces recalés du parrainage, que l’article 92 de la Constitution dispose très clairement que les décisions du Conseil constitutionnel sont insusceptibles de recours et s’imposent aux pouvoirs publics et à toutes les autorités administratives et juridictionnelles.
Aujourd’hui, le Président revient ensuite pour prendre encore ces recalés au parrainage et les amener dans un dialogue avec les candidats qui ont été définitivement retenus, ça veut dire qu’il ne tire pas toutes les conséquences de la décision du Conseil constitutionnel qu’il dit vouloir appliquer.
Ce n’est pas parce que le Conseil constitutionnel a censuré la loi sur le report et le décret qui va avec que le Président en appelle à des concertations.
Donc, là aussi, c’est une contradiction. Vous ne pouvez pas à la fois approuver et désavouer le Conseil constitutionnel. Approuver le Conseil constitutionnel parce qu’on a appelé les candidats définitivement retenus mais aussi désavouer le Conseil en disant que les recalés du parrainage doivent aussi participer aux concertations alors que la décision est définitive et que personne n’a le droit de la remettre en question et c’est ce que le Président avait dit lorsqu’il avait reçu les recalés du parrainage».
«Autre chose également, le Président dit que son décret s’est basé sur la loi mais là aussi, c’est inexact parce qu’en réalité, le décret a précédé la loi.
Donc, le décret ne peut pas avoir précédé la loi et s’être basé sur la loi pour être pris. C’est une contradiction».
«Autre chose également, c’est que le Conseil lui a fait savoir que le décret que vous prenez, ce n’est pas un pouvoir discrétionnaire encore moins un acte de gouvernement mais c’est une compétence liée en application de la loi électorale et de la Constitution. Donc, on a toutes ces contradictions qu’il faut relever dans l’adresse du Président de la République».
«Il y a aussi cette date fatidique du 2 avril. Or, le Conseil constitutionnel en censurant la loi portant report de l’élection présidentielle parce qu’il y a une incidence en ce sens que cela proroge le mandat du Président de la République, cela entraine la censure du décret. C’est comme si le décret que le Président avait pris pour arrêter le processus était illégal ou même non avenu parce qu’une compétence liée. Ce n’est pas un pouvoir discrétionnaire.
Ça ne veut pas dire que j’ai envie de convoquer le corps électoral, je le convoque. Je n’ai pas envie de le convoquer, je ne le convoque pas.
C’est une compétence liée. Il est dans l’obligation de convoquer le corps électoral parce que c’est ce que lui demande de faire la loi électorale et la Constitution. Donc, ce qu’il y avait lieu de faire, c’est de mettre en mouvement le processus et que même si le processus est mis en mouvement et qu’on arrive à organiser le 1er tour du scrutin avant la fin du mandat du Président de la République, on peut concevoir qu’il y aurait une poursuite continue de l’effectuation du scrutin.
Si on va au 2nd tour, on est toujours dans cette dynamique d’organisation d’une élection.
En ce moment, l’article 36 de la Constitution qui dit que le Président de la République sortant reste en fonction jusqu’à l’installation de son successeur, a du sens mais. En revanche, si l’élection n’est pas organisée avant le 2 avril et qu’entre-temps, le mandat du Président de la République expire, on est dans une autre configuration, c’est là où on va se retrouver dans une crise politique qui peut être grave parce qu’en ce moment, le Président de la République va détenir un pouvoir de fait. C’est-à-dire un pouvoir qui ne peut être fondé ni sur la légalité ni sur la légitimité».
