L’affaire qui oppose le Regroupement des chauffeurs de taxis urbains du Sénégal à Yango, Yassir et Heetch a été plaidée hier, lundi, 14 avril 2025, en audience spéciale devant le tribunal correctionnel de Dakar. Pour une présumée concurrence déloyale, les chauffeurs de taxis réclament 500 millions de dédommagement à ces multinationales. Ces dernières aussi leur réclament la même somme pour procédure abusive.
L’affaire des taxis urbains du Sénégal contre les multinationales, Yango, Yassir et Heetch a été plaidée en audience spéciale hier, lundi, 14 avril 2025 devant le tribunal correctionnel de Dakar. C’est le 18 juillet 2024, par le biais de leurs avocats, qu’ils avaient servi une citation directe à ces trois multinationales. Le Regroupement des chauffeurs de taxis leur reproche des faits présumés de concurrence déloyale.
D’après Modou Seck, le représentant de ce regroupement de chauffeurs de taxis, pour faire le transport urbain, il faut remplir certaines conditions. Parmi ces conditions, dit-il, il faut muter la voiture pour faire du transport urbain, faire une visite technique tous les 6 mois, (alors qu’eux, Yango, Yassir et Heetch ne font la visite technique que par an), une assurance de voyage qui couvre les clients à bord du taxi, (alors que Yango et autres n’en ont pas).
Il faut qu’il y ait une autorisation d’exploitation ou une licence puisque quiconque ne l’a pas, voit sa voiture mise en fourrière. Mais d’après lui, Yango et les autres multinationales roulent sans permis d’exploitation. Embrayant sur les conditions qu’un chauffeur de taxi urbain doit remplir,
Modou Seck d’expliquer : « il faut être détenteur d’un permis de transport en commun catégorie D, faire les visites catégories puisque c’est le chauffeur qui doit faire du transport et non un particulier. Ce que nous avons respecté contrairement aux autres que nous avons traînés ici et qui ne remplissent pas cette condition.
Il faut aussi que le chauffeur soit détenteur d’un livret qui montre que le conducteur est un chauffeur professionnel, (c’est un commissariat qui délivre ça). Mais ces multinationales n’ont pas cela puisqu’ils ne sont pas reconnus comme transporteurs urbains. En gros, ils n’ont aucun papier pour exercer ce transport public alors que seuls les taxis sont habilités à faire ce type de transport. C’est pour ça qu’on les a traînés en justice ».
Les complaintes des taximen
Le représentant des parties civiles a indiqué que cette » concurrence déloyale » a commencé depuis 2021. S’offusquant de la manière dont Yango et autres se sont immiscés dans leur secteur, Modou Seck a précisé que ces taxis peuvent faire du Yango, Heetch et Yassir à condition qu’ils remplissent les conditions.
Les pratiques de ces multinationales, selon lui, ont engendré un préjudice.
» Cela nous cause un préjudice énorme car il y a une énorme perte d’emplois. Nous nous plaignons des particuliers qui ont assailli notre métier sans pour autant remplir les conditions concernant le transport urbain. Tout véhicule qui est apte à faire du transport, peut entrer dans la plate-forme s’il respecte les conditions », a-t-il tonné.
Les avocats des taximen parlent de concurrence déloyale
Constitué pour défendre les intérêts des parties civiles, le Regroupement des chauffeurs de taxis urbains, Me Aliou Sawaré dira que c’est un exercice illégal de cette activité que font ces multinationales. Sur ce, précise-t-il, l’infraction est constituée et constatée par un huissier. Son confrère, Me Ibrahima Mbengue a pour sa part déclaré que ce qui les inquiète, c’est le comportement de ces multinationales.
Car, ajoute-t-il toujours, il y a des transporteurs réguliers avant que ces multinationales ne viennent.
« Ils ont trouvé sur place une activité bien réglementée. Ces nouvelles entreprises ne doivent pas entrer en concurrence avec le système des taxis traditionnels qui était déjà là. Ce sont des gens qui viennent de nulle part et qui nous impose un système en toute illégalité », a fait observer la robe noire.
Le conseil qui réclame 500 millions de dédommagement pour le regroupement des chauffeurs de taxis soutient toujours : « ce que nous récriminons aussi était bien né avant ce nouveau décret de 2024 parce que la condition des taximen avait chuté depuis 2021. Et même le nouveau texte exige que tout véhicule qui fait du Yango mentionne Vtc sur sa voiture pour permettre aux agents d’effectuer leur travail.
Alors qu’aucun véhicule particulier ne le mentionne.
Cela prouve qu’ils sont dans une illégalité totale. Pourquoi vouloir tuer cette activité qui nourrit des milliers de famille ? Qu’on ne se cache pas derrière le terme Vtc. Parce que qui dit Vtc, dit chauffeur ».
À sa suite, le procureur a requis l’application de la loi pénale contre ces multinationales.
L’avocat de Yango parle de procédure est vexatoire
Pour la défense de Yango, Me Daouda Seck a demandé que toutes les demandes en réparation formulées par les conseils des parties civiles soient rejetées. À cet effet, Me Seck a fait une demande reconventionnelle parce que selon lui, cette procédure est vexatoire.
Il a ainsi réclamé la même somme de 500 millions de F Cfa au Regroupement des chauffeurs de taxis urbains.
Pour ce qui est de Me Bocar Arfan Ndao qui défend Heetch, il a aussi demandé que le Gie des chauffeurs soient déboutés puisqu’il n’a pas vocation à faire des bénéfices. Me Ndao estime que cette citation aurait dû être faite si le Gie avait subi un préjudice qui est né des agissements de ses clients. Délibéré au 23 juillet 2025.
