Au Sénégal, pour qu’un individu soit éligible en tant que candidat à l’élection présidentielle, il doit se conformer à plusieurs règles législatives, dont l’une implique le dépôt d’une caution substantielle. Cette caution, fixée à 30 millions de francs CFA, doit être versée à la Caisse de dépôt et de consignation (CDC).
La loi sénégalaise stipule également que si la candidature d’un individu est rejetée par le Conseil constitutionnel, responsable de la vérification de l’éligibilité des candidats, une attestation justifiant le rejet doit être délivrée au candidat.
Cette attestation est essentielle pour que le candidat puisse effectuer une « main levée » sur la somme déposée, lui permettant ainsi de récupérer sa caution.
Lors du dernier cycle électoral, 93 dossiers de candidature ont été soumis au Conseil constitutionnel, parmi lesquels seulement 19 ont été retenus. Certains des candidats non retenus ont exprimé leur mécontentement, se disant « spoliés » par ce qu’ils considèrent comme une étude injuste de leur dossier par le Conseil constitutionnel.
Ils se sentent lésés, estimant que leur candidature a été injustement rejetée.
Dans ce contexte, le député Cheikh Abdou Bara Dolly Mbacké, lui-même un candidat non retenu, a lancé un appel à l’action.
Il a encouragé tous les candidats non retenus à se présenter au siège du Conseil constitutionnel afin de réclamer l’attestation de main levée nécessaire pour récupérer leur caution auprès de la CDC : « je demande à tous les candidats qui n’ont pas été retenus d’aller récupérer leur argent au niveau de la CDC et l’utiliser pour aider les populations », a-t-il confié à Senego.
Cheikh Abdou Bara Dolly voit dans cette démarche une opportunité pour les candidats de tourner la page et de contribuer positivement à la société sénégalaise, en aidant « d’une manière ou d’une autre », tout en permettant au pays de progresser vers les élections sans interruption.
