Au lendemain de la conférence de presse du Groupe E-Media Invest proclamant sa légitimité à diffuser les matchs de la Coupe du monde de football 2022, la Radiodiffusion télévision du Sénégal (Rts) est montée au créneau. Par la voix de son avocat, Me Alassane Cissé, la chaîne publique donne sa «vérité».
Le contentieux entre la Radiodiffusion télévision du Sénégal (Rts) et le Groupe E-Media Invest, autour des droits de diffusion des matchs de la Coupe du monde, connait en effet de nouveaux développements. Au lendemain de la conférence de presse tenue par le groupe de presse privé, la Rts a donné la parole à son avocat. Intervenant dans un élément diffusé sur la Rts, Me Alassane Cissé s’est voulu catégorique. «Il n’y a pas de contentieux. Un contentieux n’est même pas envisageable dans la mesure où la Rts n’a aucune relation ni de fait ni de droit avec E-Media», a souligné l’avocat. Revenant sur la genèse des faits, Me Cissé explique que c’est le défaut de paiement d’E-Media qui a amené New World Tv à revenir vers la Rts.
«Au moment d’exécuter le contrat, il y a eu une défaillance de la part de nos concurrents qui ne se sont pas acquittés du paiement des droits de diffusion à New World Tv. New World s’est conformée à la loi en les mettant en demeure. Laquelle mise en demeure est restée infructueuse dans les délais qui étaient accordés. Après, elle a procédé à la rupture pure et simple des relations de droit avec cette télé. Elle est revenue vers la Rts, avec laquelle elle n’avait pas rompu, pour lui dire : «Si vous êtes toujours intéressés, nous pouvons négocier et vous concéder ça.» On a abandonné la phase de l’offre publique, pour se retrouver dans la phase de la négociation privée.»
Selon l’avocat, c’est à partir de ce moment que la Rts a pris «des précautions précontractuelles» en s’assurant que New World n’était en relation contractuelle avec aucune autre télé. «C’est seulement à partir de ce moment que la Rts a accepté d’entrer en négociation avec New World Tv et a procédé au paiement des droits bien avant l’expiration du délai.» Selon l’avocat de la chaîne publique sénégalaise, la Rts n’a violé ni les droits d’E-Media ni de quiconque. «Elle a respecté la charte et le cahier des charge de la Fifa», indique-t-il.
