Le ministre de l’Intérieur Sidiki Kaba s’est exprimé sur le processus électoral, lors d’un point de presse tenu hier, jeudi 29 février 2024. À cette occasion, il a apporté des précisions par rapport à la fin de mandat de Macky Sall, la vacance du pouvoir, l’intérim du Président, la reprise du processus électoral entre autres.
Le ministre de l’Intérieur, Sidiki Kaba, a évoqué hier, jeudi, à Dakar, une éventuelle reprise du processus électoral, au cas où le président l’Assemblée nationale succèderait à Macky Sall à partir du 2 avril, la date marquant la fin du mandat du chef de l’État sortant. Sidiki Kaba qui s’entretenait avec des journalistes, deux jours après la clôture du dialogue national, a estimé que « c’est le président de l’Assemblée nationale qui devient automatiquement président de la République », à supposer que le Conseil constitutionnel serait amené à constater une ‘’vacance du pouvoir ».
Le président de l’Assemblée nationale, accédant ainsi aux plus hautes fonctions de l’État, sera alors « tenu d’organiser l’élection dans un délai de soixante à quatre-vingt-dix jours, ce qui signifie qu’il n’y a plus de droits acquis », qu’il n’y a plus 19 candidats retenus à l’issue de la première phase de vérification effectuée par le Conseil constitutionnel, « c’est la réouverture des candidatures », a-t-il-précisé.
« Donc, tout le processus va reprendre, c’est ce qui va se passer si c’est le président de l’Assemblée nationale qui devient président de la République », a insisté M. Kaba.
Il estime par ailleurs que « dans ce cas de figure, les pouvoirs du président de l’Assemblée nationale seront aussi très limités ». « Il y a un certain nombre d’actions qu’il ne peut pas faire, et qui sont énumérées dans la Constitution. Son pouvoir principal reste l’organisation de l’élection présidentielle », a-t-il- souligné.
Quid de la fin de mandat de Macky Sall ?
Selon lui, « nous sommes dans une situation inédite, car la Constitution avait prévu trois cas de figure : l’empêchement, la démission et le décès ». Et de poursuivre : « Dans notre Constitution, l’article 39 précise qu’en cas de démission, d’empêchement ou de décès le président de la République est suppléé par le président de l’Assemblée nationale.
C’est ce que dit la Constitution », a -t-il dit. Mais, poursuit-il, on n’est pas dans ces trois cas. D’après Me Kaba, « c’est un chef d’Etat qui arrive pour la première fois à la fin de son mandat qui décide de façon claire et nette qu’il ne poursuivra pas et que sa mission s’arrête le 2 avril. Alors que va-t-il se passer ? Est-ce qu’il faut considérer ça comme un cas de vacance ? Cette question n’avait pas été tranchée au Sénégal», a-t-il précisé.
Dans ce cas, le ministre de l’Intérieur a déclaré que « le Conseil constitutionnel ne tranche que de deux façons : il peut appliquer les textes de l’article 36 qui stipule que le président de la République devra rester au pouvoir pendant deux mois avant de remettre les pouvoirs à son successeur démocratiquement élu par les Sénégalais ou il peut dire qu’il s’agit de « vacance de pouvoir » et dans ce cas, c’est le président de l’Assemblée nationale qui devient automatiquement président de la République ».
A noter que le Président Macky Sall a réaffirmé, ce jeudi 29 février 2024, qu’il partira le 2 avril, date de fin de son mandat, dans un message sur X. Les conclusions d’un dialogue national organisé lundi et mardi ont recommandé que l’élection présidentielle, initialement prévue le 25 février, se tienne le 2 juin, soit deux mois après la fin officielle du mandat de Macky Sall et que ce dernier reste en fonction jusqu’à l’installation de son successeur.
