En plus des trois mois d’emprisonnement ferme qu’il devra purger, Birane Cissé va devoir rembourser à son employeur, Ibnou Gueye, 9,4 millions pour toutes causes et préjudices confondus. Il a été reconnu coupable d’abus de confiance pour avoir détourné 8,4 millions des caisses du magasin dont il avait la gérance.
Le tribunal correctionnel de Diourbel, dans la décision qu’il a rendue hier mardi 21 juin 2022, dans l’affaire opposant le ministère public à l’homme d’affaires Ibnou Gueye, à Birane Cissé, a fait preuve de clémence à l’encontre de l’accusé.
En effet, la Cour qui a reconnu la culpabilité du sieur Birane Cissé, poursuivi pour le délit d’abus de confiance, a condamné ce dernier à une peine de trois mois ferme là où le représentant du ministère public avait requis pour la répression une peine de deux ans ferme.
Par contre, le tribunal a pleinement accédé à la demande de la partie civile qui avait sollicité par la réparation 8,4 millions à titre de remboursement et un million de dommages et intérêts.
Né en 1983 au quartier Keur Mame Cheikh Ibrahima Fall de Diourbel où il est toujours domicilié, Birane Cissé comparaissait devant la barre pour répondre du délit d’abus de confiance suite à une plainte de son employeur, le célèbre homme d’affaires, Ibnou Gueye. A l’origine des bisbilles opposant les deux antagonistes, un déficit de plus de huit millions de francs Cfa constaté dans la comptabilité le vendredi 16 avril dernier.
Ce fameux jour, c’est Ya Awa Gueye, superviseur de l’entreprise et petite sœur du sieur Ibnou Gueye, qui découvre le pot aux roses lorsqu’elle a effectué le bilan financier. Ayant cumulé plusieurs versements qu’il se devait d’aller systématiquement verser à la banque, le gérant Birane Cissé n’a pu expliquer un trou de plus de huit millions. Ceci, alors qu’il est le seul détenteur des clefs du grand magasin de dépôt de bonbonnes de gaz qu’il occupe depuis plusieurs années.
Quand Ya Awa Gueye lui demande des comptes, il la supplie de ne pas ébruiter l’affaire, la priant de ne pas en informer son propre père de peur d’essuyer la honte au sein de sa famille. La seule explication erronée qu’il fournit, c’est que l’argent avait disparu avec ses fiches.
A partir de ce moment, Ya Awa Gueye en informe son grand frère et patron, Ibnou Gueye. Mais malgré les nombreuses interpellations qui lui ont été faites et les demandes d’explications sur les motifs de la disparition de l’argent, Birane s’est gardé de donner une explication plausible. Une raison qui a poussé Ibnou Gueye à aller se plaindre au commissariat central de Diourbel. Et quelques heures après la plainte, la police entre en action en allant interpeller Birane Cissé.
Aucune effraction n’ayant été constatée au niveau du magasin, ce dernier qui a été embarqué dans son lieu de travail est resté de marbre devantles enquêteurs à qui il a servi la même explication .
Devant la barre, Birane Cissé qui déclare avoir commencé sa collaboration avec Ibnou Gueye depuis 2012, confie qu’il recevait un salaire mensuel de 150 mille francs. Selon lui, l’argent a disparu durant le weekend. Néanmoins, il a indiqué que l’argent n’était pas de 8,4 millions mais un peu moins de 8 millions.
Au procureur Aly Ciré Ndiaye, l’accusé déclare qu’il soupçonne que l’argent aurait disparu lorsqu’il est allé se laver dans les toilettes du dépôt sans fermer à clé la porte du bureau. Aussi, il a indiqué n’avoir remarqué la disparition de l’argent que le lundi quand il a ouvert le magasin.
Mais les arguments tirés par les cheveux selon les avocats de la partie civile en l’occurrence Mes Assane Dioma Ndiaye et Moustapha Ndiaye ne pouvaient en aucun cas prospérer parce que dénués de sens, après avoir souligné la mauvaise foi de l’accusé.
Au terme de leurs plaidoiries, les conseils du plaignant ont sollicité une compensation financière de dix millions Cfa comprenant les 8,4 millions manquants et un million de dommages et intérêts. Finalement, Birane Cissé a écopé de trois mois de prison ferme et 9,4 millions de francs Cfa pour toutes causes et préjudices confondus.
